Terms and Conditions of Service

This document sets out the terms and conditions under which Cheshiremedica Ltd (trading under Kelsall Surgical Centre) (“the Clinic”, “we”, “us” or “our”) provides services to patients (“you” or “your”). By booking, attending, or receiving services, you agree to be bound by these Terms and Conditions.
For the purposes of these Terms:
Business Days are defined as Monday to Friday, excluding public holidays in England and Wales. Business Hours are defined as 09:00 to 17:00 on Business Days, unless otherwise stated or agreed in writing by the Clinic.

1. Eligibility
1.1. The Clinic provides services only to patients aged 18 years or over.
1.2. By booking or attending an appointment, you warrant that you meet the minimum age requirement.
2. Appointment Booking and Administration
2.1. Appointments may be made via referral from an optometrist, GP, or other medical professional, or by self-referral.
2.2. Consultants provide services directly to patients on behalf of the Clinic.
2.3. The Clinic shall ensure that the facility selected for treatment provides appropriate services, including rooms, nursing, and equipment, where services cannot be performed at the Clinic.
2.4. You agree to:
2.4.1. Provide accurate medical and ocular history;
2.4.2. Follow all pre- and post-treatment instructions and professional advice; and
2.4.3. Notify the Clinic promptly of any health changes, adverse reactions, or concerns.
2.5. Failure to comply with clause 2.4 may affect treatment outcomes and patient safety.
3. Fees and Payment
3.1. All fees are payable in accordance with the payment terms set out in these Terms.
3.2. Treatment may be billed individually or as part of an inclusive package, in which case you will receive written details of inclusions and exclusions.
3.3. Insurance patients must provide valid pre-authorisation. Any balance not covered by insurance is your responsibility.
3.4. Payment methods include debit/credit card, cheque, or electronic transfer (e.g., BACS).
3.5. Failure to pay in accordance with these Terms may result in:
3.5.1. Suspension of services; and/or
3.5.2. Referral of outstanding balances to third-party debt collection agencies.
3.6. Termination of Services by the Clinic
3.6.1. The Clinic may terminate the provision of all or part of the services, by written notice to you, immediately if:
(a) You fail to pay any sums due in accordance with these Terms (Clause 3.5);
(b) You engage in abusive, aggressive, or harassing behaviour towards any member of Clinic staff or other patients; or
(c) You materially breach these Terms, including but not limited to persistent non-compliance with professional advice (Clause 2.4.2).
3.6.2. If the Clinic terminates services for reasons other than clinical appropriateness, you shall remain liable for all services rendered up to the date of termination.
4. Inclusive Treatment Packages
4.1. Where an inclusive package is provided, it may include:
4.1.1. Consultant and anaesthetist fees;
4.1.2. Nursing care and facility charges;
4.1.3. Medications and materials (consumables/devices) used during treatment;
4.1.4. Follow-up consultations and outpatient tests explicitly agreed in writing; and
4.1.5. Re-admissions for complications arising from the original treatment.
4.2. Exclusions from inclusive packages include:
4.2.1. Personal expenses (e.g., telephone, newspapers, guest meals);
4.2.2. Additional or unrelated treatments;
4.2.3. Non-medically required revision procedures;
4.2.4. Long-term or routine post-operative care outside the agreed package.
5. Cancellation and Refunds
5.1. Full refund shall be provided if cancellation is made more than 14 business days prior to the scheduled appointment or if treatment is deemed clinically inappropriate.
5.2. A 50% refund shall be provided if cancellation is made between 14 business days and 48 business hours prior to any appointment type.
5.3. No refund shall be given for cancellation within 48 business hours of any appointment type or in the event of non-attendance (“no-show”).
5.4. Appointment Attendance
5.4.1. If you are unable to attend a scheduled consultation or non-surgical appointment, you must notify the Clinic as soon as possible.
5.4.2. For any appointment type, failure to attend without giving at least 48 Business Hours' notice may result in a non-attendance fee equivalent to the full or partial cost of the scheduled appointment, at the Clinic's discretion.
5.4.3. If you arrive more than 15 minutes late for any scheduled appointment (including consultations or pre-assessments), the Clinic reserves the right to treat the appointment as cancelled by you (“no-show”). In this event, the terms of Clause 5.4.2 or Clause 5.3 (for any appointment type) will apply, and the appointment will need to be rescheduled subject to availability and payment of any cancellation fee.
5.5. No refund shall be provided if a patient elects to discharge themselves against clinical advice.
5.6. Clinical pre-assessment charges will be billed separately if treatment does not proceed.
6. Provision of Services and Risk
6.1. The Clinic shall provide services in accordance with professional standards and applicable UK medical regulations.
6.2. Surgical Risk Statement: All surgical procedures carry inherent risks, including potential visual loss or failure to achieve the desired outcome. Your surgeon shall discuss risks and benefits relevant to your circumstances at the pre-operative consultation.
6.3. Patient Consent
6.3.1. Treatment, including surgical procedures, will only commence after you have received a full explanation of the proposed procedure, alternative options, the inherent risks (as detailed generally in 6.2), and potential benefits from your Consultant Surgeon.
6.3.2. Prior to any treatment, you must provide explicit, written, and fully informed consent. This written consent document will stand as an integral condition of these Terms and Conditions for the specific treatment provided.
6.3.3. You acknowledge that if informed consent is not provided or is withdrawn prior to the procedure, the Clinic reserves the right to cancel or postpone the scheduled treatment, which may result in charges for preparation or clinical assessment fees (as outlined in Clause 5.6).
6.4. The Clinic may refuse or postpone treatment if it is clinically, legally, or ethically inappropriate.
6.5. Outcomes cannot be guaranteed.
7. Liability and Limitations
7.1. The Clinic’s total liability for any claim arising under or in connection with these Terms shall not exceed the amount paid for the specific service in question.
7.2. Nothing in these Terms limits liability for death, personal injury, fraud, or other liabilities that cannot be lawfully excluded.
8. Clinic Responsibilities
8.1. The Clinic shall:
8.1.1. Provide safe, professional, and ethical care;
8.1.2. Maintain confidentiality in accordance with the Privacy Policy; and
8.1.3. Address complaints promptly.
8.2. Complaints Procedure
9. Data Protection and Identifiable Data Use
9.1. Personal and health data are processed in accordance with UK GDPR and the Clinic’s Privacy Policy.
9.2. By attending the Clinic, you consent to the processing of your data for treatment purposes.
9.3. The Clinic may share identifiable data with third parties involved in your care only as necessary, including:
9.3.1. Referring clinicians (optometrists, GPs);
9.3.2. Suppliers of medical equipment or materials used in your treatment; and
9.3.3. Other healthcare professionals directly involved in delivering your treatment.
9.4. Data shared is strictly limited to what is necessary for providing care, treatment administration, or legal obligations.
9.5. You have rights to access, correct, and request deletion of your data as outlined in the Privacy Policy.
10. Third-Party Services
10.1. The Clinic is not responsible for the quality or outcomes of third-party services or products.
10.2. Third-party practitioners may operate under their own separate terms and conditions.
11. Intellectual Property
11.1. All materials provided by the Clinic, including digital content, brochures, and documents, remain the property of the Clinic.
11.2. No materials may be reproduced, copied, or distributed without the Clinic’s express permission.
12. Emergencies
12.1. The Clinic is not a 24/7 emergency service.
12.2. In the event of a medical emergency, contact NHS services or emergency services immediately.
13. Governing Law
13.1. These Terms shall be governed by and construed in accordance with the laws of England and Wales.
13.2. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to Terms
14.1. The Clinic may update these Terms from time to time.
14.2. Continued use of the Clinic’s services constitutes acceptance of any updated Terms.
15. General / Superseding Terms
15.1. These Terms supersede all prior agreements, representations, or understandings between the Clinic and the Patient.
15.2. If any provision is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
16. Force Majeure
16.1. The Clinic shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay arises from circumstances or events outside its reasonable control (a "Force Majeure Event").
16.2. Force Majeure Events include, but are not limited to, acts of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm, or default of suppliers or subcontractors.
16.3. If a Force Majeure Event occurs, the Clinic will notify you promptly and will use all reasonable endeavours to reschedule the affected services at the earliest possible date. In such an event, you will not be liable for any fees for the cancelled service, but no refunds will be issued for costs incurred by you (e.g., travel) that were not paid to the Clinic.

We accept patients over the age of 18, from anywhere in the UK, including Cheshire, Wirral, North Wales, Merseyside, Chester, Heswall, Liverpool, Birkenhead, Wallasey, Upton, Ellesmere port, Winsford, Crewe, Northwich, Runcorn and beyond.
